I found a really good deal on a ‘ 14 Jetta Hybrid back in early Feb and bought it because it was really cheap and loaded. So cheap in fact that I had no problem buying the 3 year bumper to bumper warranty. ( I was looking at hybrid hondas and this was $5000 cheaper for less miles). A few days later the hybrid system threw a code and I took it to my local VW dealer for repairs. They were in contact with the warranty providers and everything was going fine until they found that the underlying cause was from before I purchased the car.
Apparently, the codes had simply been cleared in october of 2019 ( not repaired) and because the fault is before I purchased the car, the warranty won’t pay for the repairs. I’m waiting to hear back from the dealership I bought the car from and I’ll give them a day or two to call me back but I’m not sure who to light the fire under to get this resolved.

I’d have lawyered up t he minute the extended warranty said no. I wouldn’t wait to see what the other dealer says.
I’m fighting a Toyota dealer over a leaky head gasket on my Prius, and have been for 2 months.

As someone who worked at a dealership I’ll tell you this. Either go there or get on the phone with either the general manager or service manager EVERY DAY. Dealerships have budgets to fix things like this, but they will only do so for situations they cannot avoid.
Them wanting you to go away is a powerful tool, and you’ll need to use it to get what you want/deserve .
I can’t tell you how many times my GM caved once he had to see an angry customer for the 3rd or 4 th time that week.

If you’re in Michigan, I would suggest giving Steve Lehto a call.
I would tell the warranty provider they have a choice of either covering the cost or hearing from your lawyer which will result in them getting sued, and then subsequently having to cover the cost AND your legal fees.
I would give them until the end of the day tomorrow.
And if they don’t budge, then get legal advice no later than the day after tomorrow.

Be sure to read the terms of your contract. Many of these extended warranties / service contracts specifically exclude “pre-existing conditions.” Your recourse might be against the dealer that sold you the car - fraud in the inducement might allow you to void the purchase or to recover damages. Do you know whether the dealer had the Jetta on its lot back in October 2019?

I’d echo IM’s advice to seek legal
advice sooner rather than later, but follow up with the dealer and get a “yes” or “no” first. I think both channels are worth pursuing and would suggest that the
resolution is likely to happen one of two ways: either t
he dealer gets tired of you (and/or your lawyer
)
and just fixes the thing to be rid of you, or the warranty provider pays for it and then takes over bugging
the dealer
to make them whole.

WOW this is definitely the biggest BS excuse I have heard of to avoid honoring a warranty. No one, except probably the dealer with their special scan tools, would ever know if the car had at one point thrown a CEL for the hybrid system.

I’m not sure when the dealer got the Jetta but I can understand the pre-existing conditions portion from the warranty company . I’m more focusing on the dealer because of that. Whether they knew or not, it seems like they’re the ones on the hook.

Oh, that’s a very good point. The dealership was a Honda one so the chances of them having a VW reading tool would be extremely slim.

Of course - what do you have to lose? You can certainly threaten to shit talk them on the internet. Maybe talk to the VW service manager first and see if he/she will go to bat for you with the insurance company. I had an ‘88 Camry wagon 5M that dropped 2nd gear and (after I proved to them I could drive a manual) the dealer went to bat for me and I think we each paid 1/3 of the rebuild cost. Your car wasn’t bought new like that one, but fuck yeah - take a crack at it. Make some noise.
